Welcome to UX Design Toolkit. These Terms of Service ("Terms") govern your access to and use of the UX Design Toolkit website, courses, and services (collectively, the "Services"). By accessing or using our Services, you agree to be bound by these Terms and our Privacy Policy. If you do not agree to these Terms, please do not access or use our Services.

UX Design Toolkit ("we," "our," or "us") reserves the right to modify these Terms at any time. We will provide notice of any material changes by posting the updated Terms on our website. Your continued use of our Services after such changes constitutes your acceptance of the modified Terms.

We reserve the right to disable your account at any time, including if we believe that you have violated these Terms.

Course Enrollment and Payment

Our Services include various educational courses on UX design and related topics. When you enroll in a course, you agree to pay the applicable fees as described on our website. All fees are in Euros (€) unless otherwise stated.

Payment for courses must be made in advance. We accept payment through the payment methods described on our website. By providing payment information, you represent and warrant that you are authorized to use the designated payment method.

Course fees are non-refundable except as described in our Refund Policy or as required by applicable law. If you believe you are entitled to a refund, please contact us through our website.

Refund Policy

We offer a 7-day satisfaction guarantee for our courses. If you are not satisfied with a course, you may request a full refund within 7 days of the course start date, provided that you have not completed more than 20% of the course content. To request a refund, please contact us through our website.

Refunds will be processed using the same payment method used for the original purchase. Refunds may take up to 14 business days to process.

Course Access and Completion

Upon enrollment and payment, you will receive access to the course materials for the duration specified in the course description. Some courses may provide lifetime access, while others may provide access for a limited period.

To receive a certificate of completion for a course, you must complete all required course modules, assignments, and assessments with a passing grade as specified in the course description. Certificates are issued electronically and will be available for download or online verification.

We reserve the right to modify course content, structure, or availability at any time without prior notice. While we strive to provide uninterrupted access to our courses, we do not guarantee that our Services will be available at all times.

Intellectual Property Rights

UX Design Toolkit and its licensors own all intellectual property rights in our Services, including but not limited to the website, course materials, content, logos, trademarks, and software. Nothing in these Terms grants you a right or license to use any of our intellectual property except as expressly provided in these Terms.

Course materials, including videos, presentations, documents, and assessments, are provided for your personal, non-commercial use only. You may not copy, reproduce, distribute, modify, create derivative works of, publicly display, publicly perform, republish, download, store, or transmit any course materials, except as follows:

  • You may download course materials marked as downloadable for your personal, non-commercial use only.
  • You may print or download one copy of a reasonable number of pages of the website for your personal, non-commercial use and not for further reproduction, publication, or distribution.

You must retain all copyright and other proprietary notices on any copies of course materials. You may not sell, license, rent, lease, or otherwise commercialize any course materials or content.

User Content

Our Services may allow you to submit, upload, publish, or otherwise make available content, such as comments, feedback, submissions, or project work (collectively, "User Content"). By providing User Content, you grant us a worldwide, non-exclusive, royalty-free license to use, copy, modify, create derivative works based on, distribute, publicly display, publicly perform, and otherwise exploit such User Content in connection with our Services.

You represent and warrant that:

  • You own or have the necessary rights to provide the User Content and to grant the rights and licenses under these Terms.
  • The User Content does not violate the privacy rights, publicity rights, copyrights, contract rights, or any other rights of any person or entity.
  • The User Content does not contain any material that is defamatory, obscene, indecent, abusive, offensive, harassing, violent, hateful, inflammatory, or otherwise objectionable.

We reserve the right to remove any User Content that violates these Terms or that we determine is harmful, offensive, or otherwise inappropriate.

Prohibited Conduct

You agree not to:

  • Use our Services in any way that violates any applicable law or regulation.
  • Use our Services for the purpose of exploiting, harming, or attempting to exploit or harm minors in any way.
  • Send, knowingly receive, upload, download, use, or re-use any material that violates these Terms.
  • Impersonate or attempt to impersonate UX Design Toolkit, a UX Design Toolkit employee, another user, or any other person or entity.
  • Engage in any conduct that restricts or inhibits anyone's use or enjoyment of our Services.
  • Use our Services in any manner that could disable, overburden, damage, or impair the site or interfere with any other party's use of our Services.
  • Use any robot, spider, or other automatic device, process, or means to access our Services for any purpose, including monitoring or copying any of the material on our Services.
  • Use any manual process to monitor or copy any of the material on our Services or for any other unauthorized purpose without our prior written consent.
  • Introduce any viruses, Trojan horses, worms, logic bombs, or other material that is malicious or technologically harmful.

UX DESIGN TOOLKIT DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING, BUT NOT LIMITED TO, IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

WE DO NOT WARRANT THAT OUR SERVICES WILL BE UNINTERRUPTED OR ERROR-FREE, THAT DEFECTS WILL BE CORRECTED, OR THAT OUR SERVICES OR THE SERVER THAT MAKES THEM AVAILABLE ARE FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS.

WE MAKE NO WARRANTIES OR REPRESENTATIONS ABOUT THE ACCURACY OR COMPLETENESS OF THE CONTENT OR MATERIALS ON OUR SERVICES OR THE CONTENT OF ANY WEBSITES LINKED TO OUR SERVICES.

Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT WILL UX DESIGN TOOLKIT, ITS AFFILIATES, OR THEIR LICENSORS, SERVICE PROVIDERS, EMPLOYEES, AGENTS, OFFICERS, OR DIRECTORS BE LIABLE FOR DAMAGES OF ANY KIND, UNDER ANY LEGAL THEORY, ARISING OUT OF OR IN CONNECTION WITH YOUR USE, OR INABILITY TO USE, OUR SERVICES, INCLUDING ANY DIRECT, INDIRECT, SPECIAL, INCIDENTAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO, PERSONAL INJURY, PAIN AND SUFFERING, EMOTIONAL DISTRESS, LOSS OF REVENUE, LOSS OF PROFITS, LOSS OF BUSINESS OR ANTICIPATED SAVINGS, LOSS OF USE, LOSS OF GOODWILL, LOSS OF DATA, AND WHETHER CAUSED BY TORT (INCLUDING NEGLIGENCE), BREACH OF CONTRACT, OR OTHERWISE, EVEN IF FORESEEABLE.

THE FOREGOING DOES NOT AFFECT ANY LIABILITY THAT CANNOT BE EXCLUDED OR LIMITED UNDER APPLICABLE LAW.

Indemnification

You agree to defend, indemnify, and hold harmless UX Design Toolkit, its affiliates, licensors, and service providers, and its and their respective officers, directors, employees, contractors, agents, licensors, suppliers, successors, and assigns from and against any claims, liabilities, damages, judgments, awards, losses, costs, expenses, or fees (including reasonable attorneys' fees) arising out of or relating to your violation of these Terms or your use of our Services.

Governing Law and Jurisdiction

These Terms and any dispute or claim arising out of or in connection with them or their subject matter or formation (including non-contractual disputes or claims) shall be governed by and construed in accordance with the laws of Cyprus, without giving effect to any choice or conflict of law provision or rule.

Any legal suit, action, or proceeding arising out of, or related to, these Terms or our Services shall be instituted exclusively in the courts of Cyprus, although we retain the right to bring any suit, action, or proceeding against you for breach of these Terms in your country of residence or any other relevant country.

Dispute Resolution

If you have any concerns or disputes about our Services, please contact us first. Most concerns can be resolved quickly by contacting us through our website. If we cannot resolve your concern informally, you and we agree to resolve any disputes through binding arbitration in accordance with the laws of Cyprus.

Severability

If any provision of these Terms is held by a court or other tribunal of competent jurisdiction to be invalid, illegal, or unenforceable for any reason, such provision shall be eliminated or limited to the minimum extent such that the remaining provisions of the Terms will continue in full force and effect.

Entire Agreement

The Terms, our Privacy Policy, and any terms and conditions incorporated herein by reference constitute the sole and entire agreement between you and UX Design Toolkit regarding our Services and supersede all prior and contemporaneous understandings, agreements, representations, and warranties, both written and oral, regarding our Services.
